CITY OF GEORGETOWN, STATE OF IDAHO

ORDINANCE No. 110

AN ORDINANCE OF THE CITY OF GEORGETOWN, A MUNICIPAL CORPORATION OF IDAHO, AMENDING THE ZONING MAP TO INCLUDE A PARCEL OF LAND, SAID LAND BEING MORE GENERALLY DESCRIBED AS SET FORTH IN ATTACHED EXHIBIT “A” AS R-1 RESIDENTIAL; AND CLASSIFYING SAID PARCEL AS R-1, RESIDENTIAL. ALSO PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW, THE RULE REQUIRING THAT AN ORDINANCE BE READ ON THREE SEPARATE OCCASIONS HAVING BEEN DISPENSED WITH.

WHEREAS, there are certain lands lying contiguous and/or adjacent to the City of Georgetown, which pursuant to Ordinance No. 109 has been annexed into the City Limits of the City of Georgetown in accordance with the provisions of Idaho Code §50 222(hereinafter “Annexed Property”); and

WHEREAS, Ordinance 27 provides that any new property annexed into the City shall be zoned residential; and

WHEREAS, the City set a time and place for a Hearing on the decision to zone the Annexed Property as R-1 Residential, for April 4, 2023; and

WHEREAS, following proper notice of said hearing being published and provided pursuant to Idaho Code, a public hearing was conduct on the date and time set in the Notice; and

WHEREAS, following public comment on the matter, and in conformance to the laws and ordinances of the State of Idaho and the City of Georgetown;

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF GEORGETOWN, STATE OF IDAHO AS FOLLOWS:

Section 1: That the Annexed Property described in Exhibit “A” attached hereto and made a part hereof by reference, be and hereby is classified as R-1 Residential property, and the Zoning map shall be amended to reflect said classification.

Section 2: That upon adoption of this ordinance, the City shall prepare an amended map showing the Annexed Property, as R-1 Residential and revising the zoning boundary accordingly.

Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.

Section 4: One half (1/2) plus one (1) of the members of the full council agree to dispense with the rule requiring the reading of this ordinance on three (3) separate occasions.
