Meeting called to order: 11:00 am
The Council entertained a motion from councilmember DeLoy Kunz to approve the published agenda and was seconded by councilmember Tee Steadman. All were in favor and the motion carried the council.
Ordinance #103 – amending Ordinance #58 to prohibit the deposit or placement of snow by private persons or entities on City Property, was read by the Mayor. Councilmember Marty Nate made the motion to dispense the three readings on separate occasions rule and was seconded by councilmember Greg Kunz. A roll call vote was taken and is as follows: DeLoy – yes, Greg – yes, Marty – yes, Tee – yes. Motion carries. Councilmember Marty Nate made the motion to approve Ordinance #103 and councilmember Greg Kunz seconded the motion. A roll call vote was taken and is as follows: DeLoy – yes, Greg – yes, Marty – yes, Tee – yes. Motion carries.
Ordinance #104 – water revenue bond was presented to the Council and read by the Mayor. Councilmember Tee Steadman made the motion to dispense the three readings on separate occasions rule and was seconded by councilmember Greg Kunz. A roll call vote was taken and is as follows: DeLoy – yes, Greg – yes, Marty – yes, Tee – yes. Motion carries. Councilmember Greg Kunz made the motion to accept Ordinance #104 and to adopt the summary to be published in the paper and was seconded by councilmember Marty Nate. A roll call vote was taken and is as follows: DeLoy – yes, Greg – yes, Marty – yes, Tee – yes. Motion carries.
Once Attorney Stephanie Bonney has all of the closing documents ready, she will send to the City Hall and the Mayor will sign all pages with Lynette attesting. Lynette will get these Ordinances scanned and emailed to Adam so he can send on to be published in the News-Examiner.
The chair entertained a motion from Councilmember DeLoy Kunz that council adjourns from the Special Meeting at 11:15 am. Councilmember Tee Steadman seconded the motion. All were in favor and the motion carried the council.

The Council entertained a motion from councilmember Marty Nate to approve the added agenda item of the water loan closing and was seconded by Tee Steadman. All were in favor and the motion carried the council. The Council then entertained a motion from councilmember Tee Steadman to approve the published agenda and was seconded by councilmember Greg Kunz. All were in favor and the motion carried the council.
The minutes from January 5, 2021 were read aloud by Clerk Smith. Councilmember Marty Nate made the motion to accept the minutes as read. Councilmember DeLoy Kunz seconded the motion. All were in favor and the motion carried the council.
The Mayor reported that he will list the side-by-side for sale again in another month or so once the weather warms up so that we will get more people interested. Now is not the right time of year. He also reported that he has a meeting set up with Rick Phillips of Simplot and Vaughn Rasmussen of the County Commissioners sometime in March. In other business, Lynette reported that the police car also got sold.
City Attorney, Adam McKenzie spoke to the council about he got an email from DEQ that our water project is done and they are ready to close the loan to start the process to pay it back. Adam said that where it is a Tax-Exempt Revenue Bond that it is out of his expertise, so he will forward everything on to another attorney that he uses in Boise. Her name is Stephanie Bonney, and she will get everything drawn up for us to close on February 26th. We will need to have a special meeting on February 16th at 11:00 am to adopt the Ordinance for the Revenue Bond and to give enough time for it to be published in the paper by the 24th. The loan has already accrued $12,298.05 in interest. The City will just pay it verses adding it onto the loan to keep the loan amount at $410,000 for 20 years. Payments will be due in August & February at $13,395.00 each time. Adam also wanted to follow up on some other business and reported that he has heard back from the owners on the corner and will be removing the trailer house on the property, so they won’t be installing a second water and sewer line. If the lot ever splits and a home is installed, then a second line will be required. The Mayor also requested Adam to draw up a letter to send to Bruce Esplin explaining that the City has a right of way past his place and he needs to stop blocking the road as to always allow the City access to the water tanks.
The Animal Control Ordinance Draft was discussed and Marty stated that she did not add in the fence requirements so as to not add one more thing for our maintenance crew to do and inspect. The draft was tabled until another time.
Councilmember Tee Steadman reported that he has gotten some complaints about a neighbor’s dogs chasing kids off of the school bus. Because of who’s dogs they are, Tee wondered how to handle it. It was decided that Tee would pay the owners a visit and try to get them to be more aware of their dogs and to fix the problem before further action needs to be taken.
Police Report: There were 25 contacts for the month of January. Officer Martinez did have surgery recently but is hoping to be cleared to return for work after February 21st. Lynette also reported that she has gotten reimbursement from the CARES Grant for the policeman’s salary from March-December 2020. She will check on when the reimbursement for the operating expenses will be coming through.

Maintenance Report: Shane gave his report for the month of January and stated that he and Alan have plowed snow a couple of times, they have cleaned up the shop and made some shelves, the SCADA system is up and fully functioning. The City has to do seepage tests on our sewer lagoons this year and he has reached out to three engineering firms to give us a bid for this summer, he has received one back so far and we will discuss them at our next meeting.

Office Business: There are 17 delinquent water and sewer accounts for the month of January. Lynette has a conflict with the next council meeting date and the Council said to postpone a week. There is an election on March 9th to vote on the school levy. Hansen Glass is coming to install the 2nd door in the office on March 1st or 3rd. She will work that out with Shane when he can be there to help installation if needed.

The chair entertained a motion from Councilmember DeLoy Kunz for the council to approve checks and vouchers for the month of January 2021 in the amount of $12,678.00 in the general fund, $28,666.43 in the water fund, and $61,633.77 in the sewer fund, with all funds totaling $102,978.20. Councilmember Tee Steadman seconded the motion. All were in favor and motion carried.
