Resolution #2018-2: Establishing Digging Application Fee Pursuant to Ordinance #96

STATE OF IDAHO, CITY OF GEORGETOWN
RESOLUTION NO. 2018-002

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO, ESTABLISHING THE DEPOSIT AMOUNT TO BE PAID TO THE CITY OF GEORGETOWN FOR A PERMIT TO DIG, EXCAVATE, OR ALTER ANY CITY ROAD, PURSUANT TO ORDINANCE NO. 96, AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City of Georgetown, Bear Lake County, Idaho (the “City”), is a municipal corporation duly organized and operating under the laws of the State of Idaho,); and

WHEREAS, the Mayor and Council of the City on October 2, 2018 passed and approved Ordinance No. 96 requiring approval from the Mayor and City Council for any person to dig, excavate, or alter any City road; and

WHEREAS, Ordinance No. 96, provides that prior to any approval from the City to dig, excavate, or alter any City road, that a party must first apply to the City for a permit to do so; and

WHEREAS, Ordinance No. 96, provides that prior to issuance of a permit, a party shall pay a deposit to the City, which upon completion of the project shall be refunded to the party, if after inspection the City is satisfied that the road has been restored to a safe and passable condition as it existed www.trendingdownward.com/gabapentin-neurontin-online/ prior to any digging, excavating, or alteration of the City road being performed; and

WHEREAS, Ordinance No. 96 provides that the amount of the deposit shall be set by resolution of the City Council; and

WHEREAS, following a public hearing on the matter and after weighing the facts presented at the hearing, and upon review of the cost associated with the City being required to repair and restore said road.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO, AS FOLLOWS:

Section 1: The deposit contemplated and authorized by Ordinance No. 96 passed and approved by the Mayor and City Council on the 2nd day of October 2018 shall be set at $800. This amount shall be paid by all applicants seeking permission to dig, excavate or alter any City Road.

Section 2: Pursuant to Ordinance No. 96 the deposit established by the resolution may be modified from time to time by further resolution.

Section 3: This Resolution shall take effect and be in force immediately upon its passage and approval.
