Ordinance #100 Regulation of RV’s Motor Homes, and Mobile Homes

CITY OF GEORGETOWN, STATE OF IDAHO
ORDINANCE NO. 2020-100

AN ORDINANCE OF THE CITY OF GEORGETOWN PROVIDING FOR REGULATION OF RV’S, MOTOR HOMES, AND MOBILE HOMES; ALSO AMENDING RESOLUTION #2011-1 REGARDING TEMPORARY USE PERMIT FEE; ALSO FOR PROVIDING PENALTIES FOR FAILURE TO COMPLY WITH THE TERMS OF THIS ORDINANCE.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF GEORGETOWN, IDAHO AS FOLLOWS:

Section 1: Definitions: The following definitions apply for purposes of this ordinance:

  1. Recreational Vehicle or RV: means a motor home, travel trailer, fifth-wheel trailer, park model recreational vehicle, truck camper or folding camping trailer, with or without motive power, designed for recreational or emergency occupancy. It does not include pick-up hoods, shells, or canopies designed, created or modified for occupational usage. School buses or van type vehicles which are converted to recreational use, are defined as recreational vehicles.
  2. Motor Home: means a vehicular unit designed to provide temporary living quarters, built into an integral part or permanently attached to a self-propelled motor vehicle chassis. The vehicle must contain permanently installed independent life support systems that meet the national fire protection association (NFPA) 1192 standard on recreational vehicles, and provide at least four (4) of the following facilities: cooking, refrigeration or icebox, self-contained toilet, heating and/or air conditioning, a potable water supply system, including a faucet and sink, separate 110-125 volt electrical power supply and/or LP-gas supply.
  3. Mobile Home: means a factory-assembled structure or structures generally constructed prior to June 15, 1976, and equipped with the necessary service connections and made so as to be readily movable as a unit or units on their own running gear and designed to be used as a dwelling unit or units with or without a permanent foundation.

Section 2: No RV, Motor Home, or Mobile Home shall be allowed to serve as a dwelling or residence within the City of Georgetown, except in those areas designated as a "trailer coach park" as provided in Ordinance #30.

Section 3: Notwithstanding the provisions of Section 2 herein, an RV, Motor Home, or Mobile Home may be parked or located on property within the City of Georgetown for an initial period of thirty (30) days, after which time period, the RV, Motor Home, or Mobile Home may only be used as a dwelling or residence within the City of Georgetown for those limited purposes set forth in SECTION IV of Ordinance #70, and only upon following the procedures outlined in SECTION IV.

Section 4: No RV, Motor Home or Mobile Home shall be allowed to hook onto or connect to the City of Georgetown’s water or sewer system without first obtaining permission from the City Council, and said services shall be subject to the water and sewage fees established by the City of Georgetown.

Section 5: Resolution 2011-1 is hereby amended as follows:

NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Georgetown, Idaho the approved fee schedule for a temporary use permit as permitted by Ordinance #70 is $25.00 for one (1) year while building a permanent residence; as additional time is needed an additional fee of $25.00 for each additional six (6) month period of time will be enacted. Said fee schedules shall become effective 3 May 2011 as per approval of City Council at their May 2011 Council meeting.

Section 6: Violation of the terms of this ordinance shall constitute a misdemeanor offense and shall be punishable only by a fine of up to $1,000.00. No jail or incarceration shall be imposed. Each day the RV, Motor Home or Mobile Home remains in violation of this Ordinance shall constitute a separate offense. Further, the City shall be entitled to remove the RV, Motor Home or Mobile Home at the owner’s expense.

Section 7: All other Ordinances in conflict with the terms of this Ordinance are hereby repealed.

Section 8: One half (1/2) plus one (1) of the members of the full council agree to dispense with the rule requiring the reading of this ordinance on three (3) separate occasions.

EFFECTIVE DATE: That this Ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect upon its due publication as provided by law.
