Resolution #2012-5: Fee for Sewer Connections

STATE OF IDAHO, CITY OF GEORGETOWN
RESOLUTION NO. 2012-005

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO, PROVIDING THAT THE FEE FOR SEWER CONNECTIONS SHALL BE PAID BY THOSE INDIVIDUALS AND/OR PROPERTY OWNERS USING, AND CONNECTED TO, THE CITY WATER AND SEWER SYSTEM; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City of Georgetown, Bear Lake County, Idaho (the “City”), is a municipal corporation duly organized and operating under the laws of the State of Idaho, and has for many years owned and operated a public water and sewer and wastewater system (the “System”); and

WHEREAS, on April 3, 2012, Mayor and City Council adopted Resolution No. 2012-002, which adopted new fees for sewer connections for providing sewer and water services to the citizens of the City, which fees are necessary to continue providing said services and for maintaining the System; and

WHEREAS, the Mayor and City Council of the City have determined that these fees should be paid by those individuals and/or property owners who are using water and sewer services and are connected to the System;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO, AS FOLLOWS:

Section 1: The Fee established by Resolution No. 2012-002 in the amount of $60.00 per month, shall be paid by those individuals and/or property owners, residing in homes or facilities that are presently connected to the System.

Section 2: Upon payment of the shut-off fees for water and sewer services, the fee cited in Section 1 referenced above, shall be suspended. If however at any time, the connections are turned back on the fee shall be reinstated.

Section 3: A copy of this Resolution shall be posted in the City Clerk’s office and subject to examination by any interested party.

Section 4: Any resolution, ordinance, or previous motion adopted by the Mayor and City Council, in conflict with the terms of this Resolution, are hereby repealed.

Section 5: This Resolution shall be in full force and effect upon its passage and approval by the Mayor and City Council.
