BEAR LAKE COUNTY, STATE OF IDAHO
RESOLUTION NO. 2019-01
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO, PROVIDING THAT THE FEE FOR THE WATER CONNECTIONS SHALL BE PAID BY THOSE INDIVIDUALS AND/OR PROPERTY OWNERS USING, AND CONNECTED TO, THE CITY WATER AND SEWER SYSTEM; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Georgetown, Bear Lake County, Idaho (the “City”), is a municipal corporation duly organized and operating under the laws of the State of Idaho, and has for many years owned and operated a public water and sewer and wastewater system (the “System”); and
WHEREAS, on January 2, 2007, the Mayor and City Council adopted an Amendment to Ordinance #57, which adopted the fee for the water connections for providing water services to the citizens of the City, which fees are necessary to continue providing said services and for maintaining the System; and
WHEREAS, the Mayor and City Council of the City have determined that these fees should be paid by those individuals and/or property owners who are connecting to the System and will be using water services;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO, AS FOLLOWS:
Section 1: The City requires that any fees in addition to the connection fee that are acquired in relation to establishing a connection to the System be paid by the property owner requesting the connection. These fees may consist of parts, labor, equipment, repairing of the road, etc.
Section 2: A copy of this Resolution shall be posted in the City Clerk’s office and subject to examination by any interested party.
Section 3: Any resolution, ordinance, or previous motion adopted by the Mayor and City Council, in conflict with the terms of this Resolution, are hereby repealed.
Section 4: This Resolution shall be in full force and effect upon its passage and approval by the Mayor and City Council.
