SUMMARY OF

ORDINANCE NO. 2020-99

AN ORDINANCE PROVIDING FOR THE CONTROL OF DOGS WITHIN THE INCORPORATED CITY LIMIT OF THE CITY OF GEORGETOWN; REPEALING ORDINANCE 97; AND ESTABLISHING FURTHER REGULATIONS OF CONTROL AND CARE OF DOGS KEPT IN THE CITY OF GEORGETOWN, INCLUDING BUT NOT LIMITED TO RULES FOR HUMANE TREATMENT AS WELL AS SETTING FURTHER RULES AND REGULATIONS FOR ENFORCEMENT.

A summary of the principal provisions of Ordinance No. 2020-99, of the City of Georgetown, Idaho, adopted on June 9th is as follows:

SECTION 1: Definitions of terms relevant to the Ordinance including the definition of a dangerous dog.
SECTION 2: Requires all dogs to be licensed within the City Limits
SECTION 3: Establishes $5.00 fee for an altered dog; $10.00 for an unaltered dog.
SECTION 4: Sets due date for payment of fee and requires a license to be renewed annually.
SECTION 5: Governs Kennels, their size, requires a license for the same, and sets a fee for the license of $25 plus $10 for each dog over 5.
SECTION 6: Requires a Rabies Vaccination.
SECTION 7: Sets a Penalties of $150.00 for not obtaining a dog or kennel license.
SECTION 8: Requires confinement of unspayed female dogs during heat.
SECTION 9: Provides that it shall be unlawful for a dog to run at large.
SECTION 10: Provides that it shall unlawful for a dog to disturb the peace and quiet of a neighborhood.
SECTION 11: Provides requirements for the proper care of dogs.
SECTION 12: Provides Sanitation requirements for keeping and caring for dogs.
SECTION 13: Prohibits cruelty to animals, and defines what constitutes cruelty to animals.
SECTION 14: Makes it unlawful to place or offer food or garbage in a public place or a place with public access in a way what attracts stray animals.
SECTION 15: RESERVED
SECTION 16: Provides for confinement of a biting dog.
SECTION 17: Defines a Dangerous Dog and prohibits dangerous dogs, provides that a dangerous dog may be destroyed and sets forth the circumstances requiring destruction.
SECTION 18: Fighting training and attack commands are prohibited.
SECTION 19: Dogs at Large may be impounded by a property owner if found on their property.
SECTION 20: Law enforcement has authority to enforce the provisions of this ordinance.
SECTION 21: Except for violations of the licensing provisions, a violation of this ordinance is a misdemeanor punishable by a fine up to $1,000.00.

Ordinance # 97 and Conflicting Ordinances are repealed.
Reading Requirement of Idaho Code ยง50-902 is dispensed with.
Provides that if any provision of this ordinance is determined unenforceable, the remaining provisions shall remain in full force and effect.
Provides for an effective date upon passage and publication.

The full text of Ordinance No. 2020-99 is available at City Hall, posted in the U.S. Post Office in Georgetown, and will be provided to any citizen upon personal request during normal office hours.
