ORDINANCE #61 AREA OF CITY IMPACT
AN ORDINANCE DEFINING A GEOGRAPHICAL AREA OF CITY IMPACT OF THE CITY OF GEORGETOWN: IDENTIFYING THE COMPREHENSIVE PLAN THAT SHALL APPLY WITHIN THE UNINCORPORATED PORTION OF BEAR LAKE COUNTY WITHIN THE DEFINED AREA OF CITY IMPACT; IDENTIFYING THE LAND USE AND SUBDIVISION ORDINANCE THAT SHALL APPLY WITHIN THE UNINCORPORATED PORTION OF BEAR LAKE COUNTY WITHIN THE DEFINED AREA OF CITY IMPACT; AND ESTABLISHING AN EFFECTIVE DATE. PURSUANT TO SECTION 67-6526, IDAHO CODE.
BE IT ORDAINED by the Council of the City of Georgetown, Idaho:
Section 1. PURPOSE:
The purpose of establishing an area of city impact is to identify the logical fringe area for community development and growth adjoining the City of Georgetown, Idaho. The fringe area is realizing, or will realize, development pressure that must be planned for in an orderly manner. Section 67-6526, Idaho Code, requires that cities and counties negotiate an area of city impact.
Section 2. CONSIDERATION:
The following factors were considered by the City Council in the establishment of an area of city impact for the City of Georgetown, Idaho:
A. Geographic factors; and
B. Culinary water source location and distribution system; and
C. Sewerage system and treatment facility location; and
D. Areas that can reasonably be expected to be annexed to the city in the future.
Section 3. GEOGRAPHIC AREA OF CITY IMPACT
The officially adopted geographic area of city impact of the City of Georgetown is shown on the attached map entitled, “Area of City Impact for Georgetown, Idaho.” dated June 6th, 1995.
Section 4. COMPREHENSIVE PLAN:
The comprehensive plan and subsequent amendments thereto as officially adopted by Bear Lake County, Idaho, shall apply to the area of city impact of the City of Georgetown within the unincorpomted area of Bear Lake County, Idaho.
Section 5. LAND USE AND SUBDIVISION ORDINANCES
The land use and subdivision ordinances and subsequent amendments thereto as officially adopted by Bear Lake County, Idaho, shall apply to the area of city impact of the City of Georgetown within the unincorporated area of Bear Lake County, Idaho. All actions outlined in the land use and subdivision ordinances of Bear Lake County requiring Board of Commissioners approval, within the area of city impact, shall be reviewed by the City of Georgetown prior to action by the Board of Commissioners.
Section 6. EFFECTIVE DATE:
The Ordinance shall be in force and effect the 6th day of JUNE, 1995.
