ORDINANCE NO. 103

AN ORDINANCE OF THE CITY OF GEORGETOWN AMENDING ORDINANCE NO. 58, TO PROHIBIT THE DEPOSIT OR PLACEMENT OF SNOW BY PRIVATE PERSONS OR ENTITIES ON CITY PROPERTY; ALSO PROVIDING PENALTIES FOR FAILURE TO COMPLY WITH THE TERMS OF THIS ORDINANCE.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO AS FOLLOWS:

Section 1: Ordinance No. 58 shall be amended to add Section 6, which shall read as follows:

Section 6: In addition to the above, it shall be unlawful for any private person, firm, organization, or entity to conduct snow removal from private property and deposit or place the snow removed onto any City property, without prior approval from the City Council. Any person who violates, disobeys, neglects or refuses to comply with this section shall first be given a written warning; a second violation shall be an infraction and upon conviction thereof, punishable by a fine of one hundred and fifty ($150) dollars.

Section 2: All other Ordinances in conflict with the terms of this Ordinance are hereby repealed.

Section 3: One half (1/2) plus one (1) of the members of the full council agree to dispense with the rule requiring the reading of this ordinance on three (3) separate occasions.

EFFECTIVE DATE: That this Ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect upon its due publication as provided by law.
