Resolution #37: Requiring Approved Water Systems

GEORGETOWN, IDAHO

RESOLUTION NO. 37

WHEREAS; THE GOVERNING BODY OF THE CITY OF GEORGETOWN IS CONCERNED OVER THE PROVISION OF APPROVED WATER SYSTEMS AND IMPROVEMENT OF STREETS IN SUBDIVISIONS WITHIN ONE (1) MILE OF ITS CORPORATE LIMITS; AND

WHEREAS; IDAHO STATUTES STIPULATE THAT PLATS OF PROPOSED SUBDIVISIONS WITHIN ONE (1) MILE OF THE CORPORATE LIMITS OF A CITY SHALL BE REVIEWED BY THAT GOVERNMENTAL ENTITY; AND

WHEREAS; IT IS THE CONCERN OF THE GOVERNING BODY OF THE CITY OF GEORGETOWN THAT UNDUE FINANCIAL LIABILITY WILL RESULT TO THE CITY AND TO THE TAXPAYERS THEREOF; AND

WHEREAS; IT IS THE DUTY AND OBLIGATION OF THE GOVERNING BODY TO AVERT SUCH UNDUE HARDSHIP;

NOW THEREFORE; BE IT RESOLVED BY THE TOWN COUNCIL, THAT IT SHALL BE THE FORMAL POLICY OF THE CITY OF GEORGETOWN TO DISAPROVE ANY AND ALL PROPOSED SUBDIVISIONS BEYOND THE CORPORATE LIMITS AND WITHIN ONE (1) MILE OF SAID CORPORATE LIMITS; EXCEPT AS SHALL PROVIDE FOR A WATER SYSTEM APPROVED BY THE STATE OF IDAHO AND SHALL POST BOND FOR THE IMPROVEMENT OF ALL STREETS WITHIN ITS BOUNDARIES, TO THE STANDARD ADOPTED BY THIS CITY.

ADOPTED THIS 2ND DAY OF AUGUST, 1973 IN REGULAR MEETING OF THE GEORGETOWN TOWN COUNCIL.
