Ordinance #73: Vacating Horseshoe Lane (Becky Lane)

CITY OF GEORGETOWN, IDAHO

ORDINANCE No. 73

AN ORDINANCE VACATING HORSESHOE LANE FORMALLY KNOWN AS BECKY LANE.

Whereas, application has been made to the City of Georgetown requesting that the City Council abandon and vacate the public right-of-way commonly known as Horseshoe Lane, and formally known as Becky Lane; and

Whereas, the adjoining landowners do not oppose the City of Georgetown vacating Horseshoe Lane; and

Whereas, a public hearing was held regarding the matter, and

Whereas, the City Council deems that the proposed vacation of Horseshoe Lane does not adversely affect the rights of the public;

Whereas, the Mayor in City Council has determined that it is in the best interests of the City of Georgetown to vacate the road known as Horseshoe Lane, formally known as Becky Lane;

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF GEORGETOWN, IDAHO AS FOLLOWS:

Section 1: Title and Purpose

This Ordinance shall be known, and may be referred to as the Georgetown City Ordinance Vacating Horseshoe Lane, formally known as Becky Lane, more fully described as follows:

LEGAL DESCRIPTION FOR BECKY LANE (now known as Horseshoe Lane), A PORTION THE CURTIS SUBDIVISION, BEAR LAKE COUNTY, IDAHO, Beginning at the Southwest comer of Lot 8, Curtis Subdivision, and running thence South 65°18’56” West 60 feet along the North line of the Stringtown Road right of way to the Southeast corner of Lot 7, Curtis Subdivision; thence North 24°34’47 West 200 feet along the Easterly side of said Lot 7 to the Northeast corner of said Lot 7; thence North 65°18″56″ East 60 feet to the Northwest corner of said Lot 8; thence South 24°34’47” East along the Westerly side of said Lot 8 to the Point of Beginning,

Section 2: Vacation of Horseshoe Lane

The road known as Horseshoe Lane more specifically described as follows:

LEGAL DESCRIPTION FOR BECKY LANE (now known as Horseshoe Lane), A PORTION OF THE CURTIS SUBDIVISION, BEAR LAKE COUNTY, IDAHO. Beginning at the Southwest corner of Lot 8, Curtis Subdivision, and running thence South 65°18’56” West 60 feet along the North line of the Stringtown Road right of way to the Southeast corner of Lot 7, Curtis Subdivision; thence North 24°34’47 West 200 feet along the Easterly side of said Lot 7 to the Northeast corner of said Lot 7; thence North 65°18’56” East 60 feet to the Northwest corner of said Lot 8; thence South 24°34’47” East along the Westerly side of said Lot 8 to the Point of Beginning is hereby VACATED.

is hereby VACATED.

Section 3: Conflicting Ordinances Repealed

All ordinances in conflict herewith are hereby repealed.

Section 4: Distribution of Property

The lands herein vacated shall be distributed to the adjoining property owners, in accordance with Idaho Code Section 50-311 as deemed to be in the best interests of the adjoining properties and for the public good.

Section 5: Reading Requirements of Idaho Code §50-902.

One half (1/2) plus one (1) of the members of the full council agree to dispense with the rule requiring the reading of this ordinance on three (3) separate occasions.

Section 6: Effective Date

This Ordinance shall be in full force and effect from and after its passage and approval, and publication as provided by law.

PASSED AND APPROVED by the Mayor and the City Council of the City of Georgetown, Bear Lake County, Idaho, this 1 day of July, 2008.
