ORDINANCE 58

AN ORDINANCE RESTRICTING SNOW REMOVAL ONTO PUBLIC STREETS; PROVIDING PAYMENT COSTS AND PENALITIES FOR VIOLATION OF THIS ORDINANCE; AND PROVIDING AN EMERGENCY EFFECTIVE DATE THEREFORE.

BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF GEORGETOWN, IDAHO AS FOLLOWS:

SECTION 1: It is unlawful for any person to remove snow from private property onto the traveled portion of the public streets.

SECTION 2: Any person removing snow from private properties onto the traveled portion of the public streets shall, in addition to any penalities provided herein, be responsible for all reasonable costs incurred by the City of Georgetown to remove the snow placed in the traveled portion of the public streets from private properties.

SECTION 3: Any person violating or failing to comply with any of the provisions of this ordinance shall be guilty of a misdemeanor and for each day of violation or failure to comply may be punished by a fine not to exceed THREE HUNDRED DOLLARS ($300).

SECTION 4: If any part of this ordinance is for any reason held invalid by the decision of any court or regulatory body of competent jurisdiction, such decision shall not effect the validity of the remaining portions. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 5: The City Council and Mayor having deemed an emergency exists involving the health, safety and welfare of the inhabitants of the City of Georgetown, do hereby declare an emergency and this ordinance shall take immediate effect upon its passage and publication.
