Ordinance #4: Peace and Quiet (and Amendment)

ORDINANCE #4

AN ORDINANCE FOR THE PRESERVATION OF THE PEACE AND QUIETUDE OF THE VILLAGE OF GEORGETOWN, IDAHO.

BE IT ORDAINED by the Chairman and Board of the Village of Georgetown, Idaho:

SECTION I

That it is declared a misdemeanor for any one to be drunk or disorderly in such a manner as to disturb the quiet of the neighborhood, or the peace and dignity of the Village.  Anyone guilty of the above act or acts shall be subject to at fine not exceeding $50.00.

SECTION II

That all vagrants under the laws of Idaho shall be punished by a fine not exceeding $100.00.

SECTION III

That it shall be unlawful for any keeper, proprietor, owner or attendant of any saloon, bar-room billiard or pool room, or gambling tables or rooms, to allow minors to frequent their places of business or to participate in games therein, or to sell or give to such minors any spirituous, malt or fermented liquors, under a penalty not exceeding $100.00.

SECTION IV

That it is declared a misdemeanor to play football, baseball or any such games upon any of the highways,   Anyone violating this ordinance shall be fined not exceeding $100.00.

SECTION V

That no person, save those authorized by the Statutes of Idaho, shall be allowed to carry a concealed weapon of any kind or expose one in a careless or menacing manner within the Village.  Any violation of this ordinance shall be punishable by a fine not exceeding $100.00.

SECTION VI

That it is declared a misdemeanor for anyone to fire a gun or pistol within the incorporation limits under a penalty not exceeding $100.00.  This shall not in any manner affect the shooting of an animal on a person’s own premises if done with reasonable care.

SECTION VII

That any person, the owner, proprietor, occupant, attendant of any bawdy house, house of prostitution or ill fame shall be subject to a fine not exceeding $100.00.

SECTION VIII

That any proprietor or inmate of any house of prostitution or ill fame, who shall be convicted of encouraging, harboring, allowing or acquiescing in the presence of minors in and about such house shall be punished by imprisonment in the Village jail not exceeding 30 days.

SECTION IX

That any minor found loafing or loitering upon the streets or highways of Georgetown, or in or about saloons, gaming or bawdy houses, between the hours of 9 o’clock p.m. and 6 o’clock a.m. unaccompanied by a parent, guardian or other suitable adult person and unable to give a reasonable explanation of his or her presence there, shall be guilty of a misdemeanor  punishable by a fine not exceeding $100.00.

SECTION X

Any person or persons conducting or being engaged in any game of three card Monte, E. O., roulette, thimble and shell game, French mote or other games generally known or considered as confidence or sure-thing games or any games not licensed by the Idaho Statutes shall be guilty of a misdemeanor punishable by a fine of not less than $50.00 nor more than $100.00.

SECTION XI

That any person wrongfully stealing, taking, carrying, pilfering, leading or driving away the personal property of another of less value than $60.00 shall be guilty of a misdemeanor, punishable by a fine not exceeding $100.00.

SECTION XII

That it is declared a misdemeanor for any person or persons to be engaged or participate in any disorderly assembly, riot, or tumultuous or offensive conduct; to make or cause any disorderly noises; to quarrel, fight; to use boisterous, profane or obscene language, in such a ,manner as to disturb the peace and quiet of any neighborhood, family or person, or the dignity of the town or state; any offense under this section shall be punishable by a fine not exceeding $100.00.

SECTION XIII

That anyone committing an assault, as defined by the laws of Idaho, within the Village limits of Georgetown, is guilty of a misdemeanor and punishable by a fine, not exceeding $100.00 or by imprisonment not exceeding six months.

SECTION XIV

That any person committing a battery, as define by the laws of Idaho, within the Village limits of Georgetown, is guilty of a misdemeanor, and punishable by a fine not exceeding $100.00 or by imprisonment not exceeding six months.

SECTION XV

That any person who cruelly whips, beats, or otherwise unnecessarily ill-treats an animal, or worries with dog any cattle, horses, sheep or hogs, within the Village limits of Georgetown is guilty of a misdemeanor and punishable by a fine not exceeding $100.00, or by imprisonment not exceeding six months.

AMENDMENT TO ORDINANCE #4

ORDINANCE OF THE CITY OF GEORGETOWN, IDAHO , CHANGING THE CURFEW     TIMES AS STATED IN SECTION #9

BE IT ORDAINED by the Mayor and the City Council of Georgetown, Idaho:

Ordinance #4 Section #9 of the City of Georgetown is hereby amended in the following particulars:

That any minor found loafing or loitering upon the streets or highways of Georgetown, or in or about saloons, gaming or bawdy houses, between the hours of 10:30 pm and 6:00 am unaccompanied by a parent, guardian or other suitable adult person and unable to give a reasonable explanation of his or her presence there, shall be guilty of a misdemeanor punishable by a fine not exceeding $100.00.
