Ordinance #2000-1: Permitted Uses on the Georgetown Recreational Access Property

ORDINANCE NO. 2000-1

An ordinance of the City of Georgetown, Idaho, declaring uses that will be permitted and uses that will be restricted on the Georgetown Recreational Access Property; requiring the closing of gates; exempting city and emergency vehicles from this ordinance; establishing a penalty for violation of this ordinance; waiving the rule requiring that this ordinance be read on three separate occasions; and establishing an effective date of this ordinance.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF GEORGETOWN, IDAHO AS FOLLOWS:

Section 1: The City is the owner of certain real property located in the County of Bear Lake, State of Idaho, which is more specifically described in that description attached to the Quit Claim Deed from NuWest Industries, Inc., to the City of Georgetown, Idaho, and recorded in the office of the County Recorder at Bear Lake County, Idaho, under instrument No. 173423, recorded on August 9, 1999, which property was formerly an industrial railroad track providing shipping capabilities for a mine and manufacturing plant located in Bear Lake County, Idaho, and which was deeded pursuant to the above mentioned deed from NuWest Industries, Inc., to the City of Georgetown, Idaho, by deed dated August 6, 1999.

Section 2: Said property shall be hereafter referred to as the “Recreational Access Property”, and is generally located in Sections 4,5,7,8, and 18, T11S, R44E, B. M. and Sections 13 and 14 of T11S, Range 43E., B. M.

Section 3: The use of the Georgetown Recreational Access Property is hereby limited to walking, jogging, running, horses, livestock, bicycles, 4-wheeler, motorcycles, snow machines, and motor vehicles.

Section 4: Any gates which may be constructed across said Recreational Access Property by the City shall be kept closed and shut at all times by any person or entity using the Recreational Access Property, unless otherwise designated by the City.

Section 5: Provisions of this ordinance shall not restrict vehicles belonging to the City of Georgetown, Idaho, or emergency vehicles such as fire, ambulance, or police vehicles from being driven upon the Georgetown Recreational Access Property.

Section 6: Any person or entity violating the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction of said offense, shall be punished by a fine of not more than $300.00, or by confinement in the Bear Lake County Jail for a period not longer than six (6) months, or by both such fine and imprisonment.

Section 7: The rule requiring the reading of this ordinance on three separate occasions is hereby waived.

Section 8: This ordinance shall be in full force and effect from and after its passsage, approval, and publication according to law.
